HOW TO BECOME AN APPROVED NEUTRAL

Requirements for New Approved Neutrals

  1. In order to become a new Approved Neutral of IP Neutrals of Canada, an applicant must be held in high regard in the Canadian IP community, and have:
    1. at least 15 years of IP experience as a lawyer, patent agent and/or trade-mark agent in Canada, and
    2. taken accredited mediation training courses totalling at least 35 hours (provided that up to 7 hours of the 35 hours may be fulfilled by shadowing one or more mediations mediated by an accredited mediator), and
    3. acted as a mediator in at least two mediations or have acted as lead counsel in at least 7 mediations.
  2. The initial term of an Approved Neutral of IP Neutrals of Canada is five years.
  3. An Approved Neutral may be re-appointed upon the expiry of such initial term or expiry of any successive five year term provided that the Approved Neutral shall be in good standing as provided in section 4 below, and provided further that each Approved Neutral must, during the immediately preceding five year period, have:
    1. taken accredited mediation training courses totalling at least 7 hours, or
    2. acted as a mediator in at least two mediations, or
    3. acted as lead counsel in at least 7 mediations.
  4. An Approved Neutral shall be considered to be in good standing if the Approved Neutral has paid each prescribed annual fee within the prescribed time, and remains held in high regard in the Canadian IP community.
  5. The appointment, re-appointment and removal of any Approved Neutral of IP Neutrals of Canada shall be as determined by the Board of Directors of IP Neutrals of Canada.
